Ekiti Court dissolves 12-year-old marriage over constant bikkerings

An Ado-Ekiti Customary Court on Thursday dissolved a 12-year-old marriage between Ajala Julius and his wife, Kemi.

It was learnt that the marriage was dissolved on grounds of desertion for five months, constant fighting, frequent cursing and failure of his wife to discharge her matrimonial duties.

Julius, 54, who resides at Odo Orobo, housing area in Ado-Ekiti pleaded with the court for separation, claiming that his wife does not have control.

He alleged that his wife was a night crawler, stating that she would leave the house around 4pm only to come back around 11pm.

The father of two said his wife was being stubborn and disobedient.

According to him, his wife would not give the children adequate care, saying he gives her money to prepare food for the children and will not until he prepares it himself.

He stated that anytime he challenged his wife, she always causes trouble.

Julius claimed that he had reported her to her sister and did not yield any positive result as she would always support her.

The petitioner stated that his wife had left his house since last year September with their two children.

He therefore prayed the Court to separate him and the respondent, and that the court should award the custody of the children, Ayomide , Ten years, female and Paul, seven years, male to him.

The President of the Court, Mrs Olayinka Akomolede, in her remark said the respondent appeared twice throughout the proceedings and she later stopped coming to Court.

She said it is evident during the petitioner testimony that he has a stable job and he is capable of taking care of his children.

The President, observed that the marriage had broken down irretrievably and consequently dissolved the marriage

She ruled that the custody of the two children should be awarded to the petitioner.

She also ordered that access should be granted to the respondent to see her children with notification.
